Terms and Conditions – The Event Edit CBR Pty Ltd

Effective under Australian Consumer Law (NSW & ACT)

These Terms and Conditions (“Terms”) govern all event styling and hire services provided by The Event Edit CBR Pty Ltd (“we”, “us”, “our”) to the Client (“you”, “your”). By engaging our services, you agree to be bound by the following Terms in accordance with the Australian Consumer Law and relevant state laws in New South Wales (NSW) and the Australian Capital Territory (ACT).

1. Booking & Payment

  • A non-refundable deposit of 30% is required to secure your booking.

  • The remaining balance must be paid no later than 7 days before the event date.

  • Bookings are not confirmed until the deposit is received.

  • Late payments may result in cancellation or delay of services.

2. Cancellations & Refunds

  • You are entitled to a refund or rescheduling under your rights as a consumer if services are not delivered with due care and skill, or within a reasonable time, as per the Australian Consumer Law (ACL).

  • Cancellations by the client:

    • More than 14 days before the event: Refund of any amount paid, excluding the non-refundable deposit.

    • Less than 5 days before the event: No refund unless required under the ACL.

  • Cancellations by us (due to unforeseen circumstances): A full refund will be issued, or alternative arrangements will be offered, in accordance with your consumer rights.

3. Hire Items & Styling Props

  • All hire items and styling props remain the property of The Event Edit CBR Pty Ltd at all times.

  • Items are hired for the agreed event duration only. Late returns or extensions will incur additional charges.

  • Strictly no hire item or prop is to be moved, altered, or dismantled by the client, venue staff, or event guests.

    • Any movement or interference is considered a breach of our insurance policies and occupational health and safety obligations.

    • This may result in:

      • Immediate removal of affected items,

      • A penalty fee of $1000,

      • Or full replacement cost if damage occurs.

4. Loss, Damage & Liability

  • You are responsible for the security and condition of all hire items from delivery until collection.

  • Any loss, theft, or damage (including weather-related damage for outdoor events) will be charged at the full replacement or repair cost.

  • A cleaning fee may be applied for items returned in unreasonable condition.

  • We carry appropriate public liability insurance, but we are not responsible for damage or injury caused by misuse or interference with our equipment.

5. Setup & Pack Down

  • We require confirmed venue access times for setup and pack down.

  • Delays in access or last-minute venue changes may reduce the quality of styling or incur additional labour costs.

  • We reserve the right to refuse setup if access conditions are unsafe or non-compliant with Work Health and Safety (WHS) regulations.

6. Weather & Outdoor Events

  • For outdoor events, clients must provide weather protection such as marquees or cover.

  • We reserve the right to cancel or alter outdoor installations if weather poses a safety risk.

  • No refunds will be issued for cancellations due to unsafe weather unless required under ACL.

7. Australian Consumer Law Notice

Under the Australian Consumer Law, you are entitled to services:

  • That are provided with due care and skill,

  • That are fit for the purpose you made known,

  • And delivered within a reasonable timeframe.

If we fail to meet these guarantees, you may be entitled to a refund, replacement, or compensation.

Nothing in these Terms excludes or limits your rights under the Competition and Consumer Act 2010 (Cth) or equivalent NSW and ACT consumer protection legislation.

8. Photography & Marketing

  • We reserve the right to photograph our work at your event for portfolio and marketing purposes, unless you request otherwise in writing prior to the event.

9. Client Responsibilities

  • It is your responsibility to ensure:

    • All venue staff and guests are informed not to touch, move, or interfere with any props or styling items.

    • Children and guests are supervised around delicate or potentially hazardous installations (e.g., candles, hanging décor, backdrops).

    • You have obtained any required venue permissions, permits, or approvals for our styling setup.

10. Force Majeure

  • We are not liable for any failure to perform due to circumstances beyond our control, including but not limited to: natural disasters, pandemics, government restrictions, strikes, accidents, or transport delays.

11. Governing Law

These Terms are governed by the laws of New South Wales and the Australian Capital Territory, and any disputes will be handled in accordance with those jurisdictions.
